Musuraca v. Kurlemann Builders, Inc. dba Kurlemann Homes, et al.: Three week jury trial. Mr. Bergmann successfully represented Plaintiffs in a home construction defects and Ohio Consumer Sales Practices Act case against a high-end custom home builder. Judgment of approx. $1,200,000 plus attorney fees, litigation expenses, and court costs. More

A Leading Case on Landowner Liability for Injuries Caused by Natural Defects:
Kueber v. Haas (1988), 47 Ohio App. 3d 62, 546 N.E.2d 1351: A teenager suffered brain damage when he was hit on the head by a falling tree which was located in a heavily-forested part of a homeowner’s property. The Hamilton County, Ohio Court of Appeals decided that the owner of residential property which had been preserved in its native condition could not be held liable for injuries caused by any natural defect(s) which existed there.
